A Major Change in Alberta Auto Insurance
Beginning January 1, 2027, Alberta will implement its new Care-First auto insurance system under the Automobile Insurance Act, replacing the province’s current approach to motor vehicle injury claims. Injured individuals will have access to substantially enhanced medical, rehabilitation and income replacement benefits compared with the current Section B system, while most benefit disputes will be resolved through the Alberta Automobile Care-First Tribunal rather than traditional litigation. Limited rights of legal action will remain in certain prescribed circumstances.
Claims arising from accidents before January 1st, 2027, will continue to be handled under the current tort-based system, even if the file is still active after that date. Our team is tracking this transition closely to ensure Alberta claims are calculated under the correct framework.

Frequently Asked Questions

Time limits vary by province and by claim type, so there isn't one deadline that applies everywhere. In Ontario, accident benefits claims generally need to be reported promptly, with formal applications submitted within set deadlines under the Statutory Accident Benefits Schedule (SABS). Other provinces run different systems entirely: Saskatchewan's public plan, Quebec's public automobile insurance plan, and Alberta's current Standard Owner's Automobile Policy each set their own timelines, and Alberta's rules are changing again under the new Care-First system beginning January 1, 2027. Because entitlement to benefits often depends on timely reporting and supporting documentation, we recommend starting the process as soon as reasonably possible after an accident, rather than waiting to see how the claim develops.
Timelines depend on the claim's complexity, how quickly records and documentation are provided, and whether the benefit amounts involved are disputed. A straightforward claim with clear documentation moves faster than one involving income replacement, self-employment losses, future benefits or a priority dispute between insurers, each of which requires additional analysis before a figure can be finalized. Preliminary findings can often be issued quickly once we have the core financial records, which allows insurers to make reasonable initial payments while the fuller analysis continues. The claim itself may still take longer to resolve if it becomes disputed or moves toward litigation, since that adds steps like examination for discovery or expert testimony. Our team can walk you through what's involved once we understand the file, so you have a realistic sense of the timeline.
For disputed benefits, serious or catastrophic injuries, or complex priority disputes, many claimants choose to retain a lawyer rather than deal directly with the insurer. A lawyer becomes particularly valuable once a claim moves toward negotiation, appeal or litigation. At that point, the dispute can expand beyond your initial benefits into a broader personal injury claim that can cover income loss, future care costs and other damages. Davis Martindale works directly alongside your lawyer at every stage, providing independent loss calculations that hold up whether the file stays in negotiation or proceeds to a hearing.
Our Motor Vehicle Insurance Claims team prepares the initial benefits figures. If the claim grows into a full personal injury matter, our Personal Injury Litigation team picks up the broader loss analysis. It is often the same file and the same firm, just a wider scope. If you are unsure whether your situation calls for legal representation, that is worth raising with our team early, before a dispute narrows your options.
Accident benefits are a set of benefits available to people injured in a motor vehicle accident, regardless of who was at fault, covering income replacement, medical and rehabilitation costs, and other losses tied to the injury. In Ontario, these benefits fall under the Statutory Accident Benefits Schedule (SABS); other provinces run their own systems, from Saskatchewan's and Quebec's public plans to Michigan's no-fault law and Alberta's current Standard Owner's Automobile Policy. Working out what you're entitled to often means quantifying income replacement based on employment records, self-employment income, or a financial dependency analysis if you supported family members. When the injury involves a serious or catastrophic claim, the case can move into personal injury litigation alongside the accident benefits claim — our Personal Injury Litigation team handles that side of the file.
A financial dependency analysis calculates the financial support a person provided to someone who depended on them, most often prepared when an accident affects a claimant's ability to provide that support or, in a fatality claim, when dependents have lost it entirely. This involves reviewing the claimant's employment and income history, the nature and value of the support provided, and projecting how that support would have continued going forward. Because every family's financial arrangement is different, this calculation is built around the claimant's actual circumstances rather than a standard formula. It's one of the more document-intensive parts of an accident benefits file, so the earlier the relevant records are gathered, the faster this piece of the claim moves.
